A recent crane accident at the Graphic Packaging Company in Macon took the life of one young man and injured three other workers. The tragedy reminds us all that accidents happen every day – even in our small Georgia community.

A Tragic Accident

According to Macon Warner Robins 41NBC/WMGT, a group of men were dismantling a crane at the Graphic Packaging Company in Macon when a strap broke and the crane fell apart.  Three of the subcontracted workers for the company who were injured were transferred to the Medical Center of Central Georgia and are expected to survive.  However, according to Bibb County Coroner Leon Jones, 21-year-old Johnathan Siroky of Fayetteville was killed at the scene of the accident when he was crushed between the crane and the door of a trailer.
The tragic accident brings up several questions in regard to worker safety and how the injured victims and their families, as well as Johnathan Siroky’s family, will be able move past this – emotionally, physically and financially.

Legal Remedies Available to Accident Victims & Their Families

It’s very difficult for accident victims and their families to get through a tragedy like what happened at Graphic Packaging – emotionally, physically and financially.  However, it’s important to know that legal remedies are available in these types of situations, such as workers’ compensation, wrongful death lawsuits, and pedestrian accident lawsuit.

  • Workers’ Compensation.  For the victims of this accident and their families, Georgia workers’ compensation may pay medical, rehabilitation and income benefits. These benefits are meant to help workers recover from their injuries and return to work and to provide benefits to the dependents of workers who die as a result of job-related injuries.

Anyone trying to recover from workplace injuries, or families trying to cope with the loss of their primary financial provider, should receive the benefits they deserve.  While every Georgia worker is automatically covered by workers’ compensation insurance from the first day of their employment, the truth of the matter is that workers’ compensation benefits are routinely denied or do not provide enough compensation for victims to make ends meet.
Many people simply give up if they are denied workers’ compensation benefits.  However, an experienced and aggressive Georgia workers’ compensation attorney can help you overcome the challenges of applying for compensation benefits or for appealing the denial of workers’ compensation benefits.

  • Wrongful Death.  Siroky’s family members are likely going through one of the most difficult periods in their lives.  What makes their situation worse is that he was young and that this accident likely could have been prevented.

The family may have grounds for filing a Georgia wrongful death lawsuit against the company or the subcontractor if they were negligent. While a lawsuit will not bring back their lost loved one, it may prevent other families from suffering similar losses by focusing attention on a safety issue. The family may be entitled to compensation for medical expenses, burial expenses, lost wages, benefits and in some cases, mental pain and suffering.
According to Georgia law, an eligible survivor or the estate must show that a wrongful act, neglect or default on the part of the defendant caused the death in order to prevail in a wrongful death lawsuit, Anyone who loses a loved one they depended upon financially or emotionally deserves to be compensated for their losses, and an aggressive and experienced Georgia wrongful death attorney is usually required to realize that goal.
